Welcome to FastShip Africa. These Terms of Service ("Terms") govern your access to and use of our website, platform, and logistics services, including warehousing, last-mile delivery, same-day delivery, international shipping, and all related services provided by FastShip Africa ("FastShip", "we", "us", or "our").

By accessing our website, creating an account, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

For the purpose of these Terms, the following definitions apply:

• "Customer" or "you" refers to any individual, SME, enterprise, or e-commerce business that uses or accesses the FastShip Africa platform or Services.
• "Shipment" means any parcel, package, or consignment tendered to FastShip Africa for transportation, storage, or fulfilment.
• "3PL Services" means third-party logistics services, including but not limited to warehousing, order fulfilment, last-mile delivery, same-day delivery, and international shipping.
• "Platform" means the FastShip Africa website (fastship.africa), mobile application, and any related portals or tools.
• "Carrier Partner" refers to third-party courier and logistics providers engaged by FastShip Africa to fulfil deliveries, including FedEx and other contracted partners.

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under applicable Nigerian law to use our Services. By using FastShip Africa, you represent and warrant that you meet these requirements.

2.2 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

FastShip Africa reserves the right to suspend or terminate accounts that contain inaccurate information or are in violation of these Terms.

3. Services

3.1 Scope of Services

FastShip Africa provides the following logistics and 3PL services:

• Last-Mile Delivery: Delivery of shipments to the final recipient's address within Nigeria.
• Same-Day Delivery: Pickup and delivery of shipments within the same business day, subject to applicable cut-off times and location coverage.
• International Shipping: Shipping of packages to and from international destinations, facilitated through our Carrier Partners including FedEx.

3.2 Service Availability

Our Services are available in Nigeria. International shipping is available to supported destinations as listed on our Platform. FastShip Africa reserves the right to modify, suspend, or discontinue any Service at any time with reasonable notice.

3.3 Estimated Delivery Times

Delivery timeframes, including our stated average of 1.2 days, are estimates only and are not guaranteed. Actual delivery times may vary based on various factors beyond our control.

3.4 Carrier Partners

FastShip Africa may engage Carrier Partners to fulfil some or all of a shipment's journey. By using our Services, you acknowledge that certain legs of your shipment may be handled by third-party carriers.

4. Prohibited Items

You must not tender the following items for shipment through FastShip Africa:

• Explosives, firearms, ammunition, or weapons of any kind.
• Illegal drugs, narcotics, or controlled substances.
• Hazardous materials, flammable liquids, or toxic substances.
• Perishable goods without prior written agreement.
• Cash, currency, or precious metals above declared thresholds.
• Counterfeit goods or pirated materials.
• Human remains, organs, or biological specimens.
• Any items prohibited under Nigerian law or international trade law.

FastShip Africa reserves the right to refuse or return any shipment that contains or is suspected to contain prohibited items.

5. Customer Obligations

As a Customer, you agree to:

• Provide accurate and complete shipment information.
• Ensure that all items are properly and securely packaged.
• Comply with all applicable laws and regulations.
• Not use the Services for any unlawful, fraudulent, or deceptive purpose.
• Ensure the recipient is available for delivery.

6. Pricing, Payment, and Billing

6.1 Pricing

Service fees are calculated based on shipment weight, dimensions, destination, and service type. FastShip Africa reserves the right to revise pricing at any time.

6.2 Payment

Payment is due at the time of booking unless otherwise agreed in writing. All transactions are processed in Nigerian Naira (NGN) unless otherwise specified.

6.3 Additional Charges

Additional charges may apply for failed delivery attempts, re-delivery, storage, or customs duties.

6.4 Refunds

Refund eligibility is assessed on a case-by-case basis. Refunds will not be issued for delays caused by circumstances beyond FastShip Africa's reasonable control.

7. Tracking and Notifications

FastShip Africa provides real-time shipment tracking through our Platform. We do not guarantee the real-time accuracy of tracking data.

8. Loss, Damage, and Liability

8.1 Liability for Loss or Damage

FastShip Africa's liability for loss or damage is limited to the declared value of the shipment or a maximum liability cap, whichever is lower.

8.2 Claims Process

To file a claim, you must notify FastShip Africa within 48 hours for domestic shipments or within 7 days for international shipments.

8.3 Limitation of Liability

FastShip Africa shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Services.

9. Intellectual Property

All content on the FastShip Africa Platform is the property of FastShip Africa or its licensors and is protected by applicable laws.

10. Privacy and Data Protection

FastShip Africa collects and processes personal data in accordance with our Privacy Policy available at fastship.africa/privacy-policy.

11. Indemnification

You agree to indemnify and hold harmless FastShip Africa and its agents from any claims or losses arising out of your use of the Services or breach of these Terms.

12. Force Majeure

FastShip Africa shall not be liable for failure or delay in performing its obligations due to circumstances beyond our reasonable control.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us.

13.2 Termination by FastShip Africa

FastShip Africa may suspend or terminate your account for breach of these Terms or suspected fraudulent activity.

14. Dispute Resolution

14.1 Informal Resolution

We encourage you to first contact our customer support team to seek an informal resolution.

14.2 Governing Law

These Terms shall be governed by the laws of the Federal Republic of Nigeria.

14.3 Jurisdiction

Any dispute shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

15. Amendments to These Terms

FastShip Africa reserves the right to update or modify these Terms at any time. Your continued use of our Services constitutes acceptance of the revised Terms.

16. Severability

If any provision is found to be invalid, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and FastShip Africa.
